DSS to pay N1m fine over cleric’s illegal detention

A Federal High Court sitting in Oke-Mosan, Abeokuta, the Ogun State capital has ordered the Department of State Security to pay one million Naira over illegal detention of an Islamic cleric, Abdul-Ganiyy Ibrahim-Jimoh.
The court also ordered immediate release of the cleric who had been in custody of DSS for almost a year, declaring his arrest as unconstitutional, illegal and abuse of his human rights.

Delivering the judgement yesterday in a case brought to the court by the Prisoners Right Advocacy Initiative (PRAI), Justice Folake Ogunbanjo held that the continuous detention of the applicant since 5th July, 2014 without trial is against the provisions of the constitution.
The cleric, alongside his pregnant wife, Muinat Ibrahim – Jimoh were arrested in his Ijoko-Ota residence by security operatives but were later found in the custody of of the DSS at the Ogun State headquarters.
The wife who was released last September when her Expected Delivery Date, EDD was approaching was the one who gave information on the whereabouts of her husband.
Both the Director-General of DSS and the Attorney General of the Federation, were joined as 2nd and 3rd respondents respectively in the case with suit number FHC/AB/C8/84/2014.
